"I don't think it's representative of a larger issue," Kendall said in response to Military.com during a media roundtable. "Gen. Stewart has not been convicted yet, so I don't want to say anything about his guilt or innocence. We take these cases incredibly seriously."

Unfortunately, Secretary Kendall perpetuates the wrongheaded idea, seen so often in public statements nowadays, that a criminal trial is about "guilt or innocence". It isn't.

An accused is always presumed innocent as a matter of law. The accused's innocence is not at issue. The issue is whether the government, through evidence properly admitted at trial, has overcome that presumption and proven the accused's guilt beyond a reasonable doubt.

The Judge Advocate General of the Air Force ought to take Sec. Kendall into a classroom and make him write "presumed innocent until proven guilty in a court of law" one thousand times on the chalkboard.

Well, if the message was to "acquit," then the case wouldn't have been referred to trial, especially in light of the PHO's report, which should've served as the most forceful hint, hint, foot stomp ever.

His recent comments might have been tempered by his recent experience as a witness in a GCM motion regarding UCI.
